FAQs About Personal Injury Law

Every day people all over the country get injured from a variety of things including car accidents, dog bites, slip and falls, construction accidents, and more. These things leave people in a bad condition and facing mounting medical bills, make them unable to work, and cause a lot of stress. They are also the cause for a personal injury case to be filed. Cases are complicated and most people do not understand the law surrounding personal injuries. That is why our clients always have a lot of questions and rightfully so. So, we have compiled a list of some of the frequently asked questions that we receive from our clients and their respective answers:

  • How much will my compensation be?

There is no standard compensation amount for each case. Every case is unique. It will depend on the type of injuries you have, the extent of those injuries, property damage caused, and more. Our attorney can help determine an estimate of how much your case may be worth.

  • Should I respond to calls from insurance companies and the defendant’s lawyers?

No, do not answer calls from insurance companies or other lawyers. They will attempt to intimidate you or get you to admit fault. Your personal injury lawyer will be the one to handle all communications with the insurance company and any other lawyers.

  • What factors are used to determine the value of my case?

The factors used to determine the value of your case include how you were injured, who was at fault, the injuries sustained, what medical treatments were received, what medical problems you are currently experiencing, and how your life was impacted.

  • What if I had a pre-existing condition before my accident?

You may still be eligible for compensation because of injuries caused by the accident. However, the compensation you receive may be reduced to compensate for the pre-existing condition.

  • How do I pay for my medical bills until I get paid?

The law does not make the insurance of the defendant pay for your medical bills until it is established that the defendant is at fault for the accident. Until that happens, you will have to cover the costs out of pocket, use the personal injury protection (PIP) coverage of your auto insurance, or use your health insurance.

  • Do I have a case if I do not feel hurt immediately?

Yes, you may have a case even if you feel fine at the scene of the accident. Biological responses are not always immediate and affect everyone differently. You may feel the effects of any trauma experienced hours later and that is okay.
